2016 January 11 From: Art Huffine Sent: 1/11/2016 5:35 PM To: Island County Commissioners Subject: Wonn Road Settlement Commissioners, I have recently been made aware that the BOICC is considering vacating the public's beach access at Wonn Road and that the negotiations with the adjacent property owner has been done in secret and with complete contempt and disregard for the position of Island Beach Access. During the recent research done by the BOICC with regards to the priorities of the citizens of Island County as it applies to the Comprehensive Plan, the highest priority was given to shoreline protection and beach access. It is beyond me how you can give serious consideration to the Montgomery's request when it so blatantly violates the trust we citizens put in your hands and is very clearly illegal according to RCW 36.87.130 (below). The RCW leaves no doubt as to the reasons that public lands that abut salt or fresh water may be vacated and it surely does not include helping rich Medina doctors keep the rif-raf off of adjacent property. I strongly urge the Board of Island County Commissioners to NOT take action on this matter at this time and let the court decide on the merits of the Montgomery's claim. No county shall vacate a county road or part thereof which abuts on a body of salt or freshwater unless the purpose of the vacation is to enable any public authority to acquire the vacated property for port purposes, boat moorage or launching sites, or for park, viewpoint, recreational, educational or other public purposes, or unless the property is zoned for industrial uses. |
